Terms of Service (GrowthOptiqs)

These Terms of Service (“Terms”) govern your access to and use of the GrowthOptiqs websites, apps, and services (the “Services”). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Definitions

  • “GrowthOptiqs,” “we,” “us,” “our” refers to GrowthOptiqs.
  • “You,” “your,” “user” refers to the individual or entity using the Services.
  • “Content” includes text, inputs, outputs, files, and materials submitted or generated through the Services.
  • “Tools” refers to calculators, audits, generators, analyses, simulations, and AI-enabled features.

2) Eligibility and Accounts

You must be able to form a legally binding contract to use the Services.

You agree to:

  • Provide accurate account information
  • Maintain the security of your login credentials
  • Promptly notify us of unauthorized use
  • Accept responsibility for all activity under your account

We may suspend or terminate accounts for suspected abuse or violations of these Terms.

3) Subscriptions, Trials, Billing, and Payments

A) Subscriptions and Trials

Some features require a paid subscription. We may offer free trials at our discretion. Trial eligibility and duration may vary.

B) Billing and Payment Processing

Payments are processed by Stripe. By subscribing, you authorize GrowthOptiqs (through Stripe) to charge your selected payment method.

C) Renewal and Cancellation

Subscriptions renew automatically unless canceled before the renewal date. You may cancel through your account settings or via Stripe’s customer portal (where available).

D) Refunds

Unless required by law, payments are non-refundable and we do not provide prorated refunds for partial periods. If you believe you were charged in error, contact support@growthoptiqs.com.

E) Failed Payments

If payment fails, we may suspend or downgrade access until payment is updated.

4) Credits and Usage Limits

Certain features may use credits or be subject to monthly usage limits.

  • Credits may reset monthly based on your plan.
  • Credits have no cash value and are not transferable.
  • We may modify credit costs or limits from time to time.

5) Third-Party Integrations

The Services may allow you to connect third-party accounts (for example, analytics platforms). You are responsible for ensuring you have the rights and permissions to connect and share that data with GrowthOptiqs.

We are not responsible for third-party services, their availability, accuracy, or policies. Your use of third-party integrations is subject to the third-party provider’s terms and privacy practices.

6) Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, or fraudulent purposes
  • Attempt to bypass access controls, subscription gating, or credit limits
  • Reverse engineer, scrape, or exploit the Services
  • Upload malicious code or disrupt performance
  • Interfere with other users’ access
  • Misrepresent tool outputs as guaranteed results

We may suspend or terminate access for violations.

7) Your Content and License to Operate

You retain ownership of the information and content you submit to the Services.

You grant GrowthOptiqs a limited, worldwide, non-exclusive license to host, process, transmit, and display your content solely to provide, maintain, and improve the Services.

You represent that you have the rights to submit your content and that it does not violate laws or third-party rights.

8) Product Improvement and Aggregated Data

You agree that GrowthOptiqs may use aggregated and de-identified data derived from your use of the Services (including tool inputs and usage patterns) to improve the Services, develop features, and produce benchmarks or reports.

We will not publicly identify you or your business in case studies or marketing materials without your explicit permission.

9) AI Tools, Analytics Outputs, and No Guaranteed Results

The Services may include projections, simulations, recommendations, benchmarks, or AI-generated content. These outputs are estimates and informational only.

You acknowledge and agree:

  • Outputs may be inaccurate, incomplete, or unsuitable for your needs
  • GrowthOptiqs does not guarantee performance, revenue, rankings, ad outcomes, or results
  • You are responsible for verifying outputs and making decisions using your independent judgment

GrowthOptiqs does not provide legal, financial, accounting, or other professional advice.

10) Intellectual Property

We own the Services and all related intellectual property, including software, branding, design, and non-user content.

You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Services unless explicitly authorized.

11) Service Availability and Changes

We may change, suspend, or discontinue any part of the Services at any time, including features, pricing, credit limits, or integrations.

We do not guarantee uninterrupted availability.

12) Termination

You may stop using the Services at any time.

We may suspend or terminate access if:

  • You violate these Terms
  • You fail to pay for a subscription
  • Your use creates risk or harm to GrowthOptiqs or others

Upon termination, your right to use the Services ends immediately.

13) Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWTHOPTIQS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100, WHICHEVER IS GREATER), UNLESS REQUIRED BY LAW.

15) Indemnification

You agree to indemnify and hold GrowthOptiqs harmless from claims arising out of:

  • Your use of the Services
  • Your content or connected accounts
  • Your violation of these Terms
  • Your violation of laws or third-party rights

16) Governing Law and Venue

These Terms are governed by the laws of Pennsylvania, USA, excluding conflict of law rules.

Any disputes will be brought in the state or federal courts located in Pennsylvania, and you consent to jurisdiction and venue there.

17) Changes to These Terms

We may update these Terms from time to time. Changes will be posted with a revised “Last Updated” date. Your continued use after changes means you accept the updated Terms.
